Terms of Service

These terms apply to web design, brand, and related services provided by James Cacchione ("I", "me", "my") to you ("you", "the client"). By engaging my services or agreeing to a written quote, you accept these terms.
1. Services
I provide web design, website development, brand identity, logo design, and related creative services. The specific deliverables, timelines, and price for your project will be set out in a written quote or proposal I send you before any work begins.
2. Quotes and proposals
- Quotes are valid for 30 days from the date issued
- Quotes are based on the information you provide — significant changes to scope may require a revised quote
- Work begins once you accept the quote in writing (email is fine) and pay the deposit
3. Payment
- Standard terms: 50% deposit to start, 50% on launch
- Complete packages: can be split into 3 or 4 monthly payments by prior agreement
- Invoices are payable within 14 days by bank transfer or other method we agree
- Late payments: invoices more than 30 days overdue may incur reasonable collection costs and accrue interest at the rate permitted under the European Communities (Late Payment in Commercial Transactions) Regulations 2012
- All prices are in Euro (€) and exclude VAT unless stated otherwise
4. Revisions and feedback
- Each package includes unlimited revisions during the design phase, provided feedback is consolidated and falls within the agreed scope
- You agree to respond to requests for feedback, content, or approvals within a reasonable time (usually 5 working days)
- Significant new additions beyond the original scope will be quoted separately
- Extended delays caused by the client may push timelines or incur additional costs
5. Client responsibilities
You are responsible for:
- Providing content (text, images, logos etc.) in a timely manner — I'll give you a simple checklist
- Ensuring any content you supply does not infringe third-party copyright, trademarks, or other rights
- Reviewing and approving drafts at each agreed stage
- Purchasing and maintaining your own domain name and hosting (unless covered by a Care Plan)
6. Ownership and copyright
- Once final payment is received, you own the final delivered website files, logo files, and brand assets
- I retain ownership of working files, source files, and preliminary concepts that were not selected
- I retain the right to display the delivered work in my portfolio and use it for marketing purposes (e.g. on jcacchione.me, social media, case studies)
- Third-party assets (e.g. stock photography, fonts, plugins) remain subject to their respective licences, which will be transferred or licensed to you as appropriate
- A small, unobtrusive "Designed by James Cacchione" credit in the site footer is appreciated but not required
7. Cancellation and refunds
- If you cancel before work begins, the deposit is refundable minus any administrative time already incurred
- If you cancel after work has begun, the deposit is non-refundable, and you will be invoiced for any additional work completed up to the point of cancellation
- If I cancel the project (rare), you will be refunded any payments made for work not yet delivered
8. Hosting and care plans
- The optional Care Plan (€45/month) includes hosting, SSL, weekly backups, software updates, and up to 1 hour of content edits per month
- Care Plans are billed monthly in advance and can be cancelled at any time with 30 days' written notice
- If you cancel the Care Plan, I will provide you with an export of your website so you can migrate to another host
9. Warranty
- I warrant that the work will be performed with reasonable skill and care
- For 30 days after launch (or longer where specified in your package), I will fix any bugs or issues with the delivered work at no additional cost
- This warranty does not cover changes made by third parties, server issues outside my control, or issues arising from your misuse of the site
10. Limitation of liability
To the maximum extent permitted by law:
- My total liability for any claim arising under these terms is limited to the fees you paid me for the project giving rise to the claim
- I am not liable for indirect, consequential, or incidental losses, including loss of profit, revenue, or data
- Nothing in these terms limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law
11. Confidentiality
Any non-public information you share with me during the project will be treated as confidential and used only to deliver the services. I'm happy to sign a mutual NDA if required.
12. Third-party services
Your website may use third-party services (hosting, plugins, fonts, booking systems etc.). These are subject to their own terms and pricing, and I am not responsible for their availability, performance, or changes to their pricing.
13. Force majeure
Neither party is liable for delays or failures caused by events outside reasonable control, including illness, natural disasters, or internet/service-provider outages.
14. Governing law
These terms are governed by Irish law. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.
15. Changes to these terms
I may update these terms from time to time. The version in effect when you accept your quote is the one that applies to your project.
